Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Nexlon platform, website, and services operated by Nexlon ("we", "us", or "our"). By creating an account or using any part of Nexlon, you agree to be bound by these Terms. If you do not agree, you must not access or use the service.

2. Eligibility

You must be at least 16 years old and able to form a binding contract to use Nexlon. By using the service, you represent and warrant that you meet these requirements and have the authority to act on behalf of any business you represent.

3. Your Account

  • You are responsible for maintaining the confidentiality of your login credentials.
  • All activity under your account is your responsibility.
  • You must notify us promptly of any unauthorized use or security breach.
  • One person or business entity may not maintain multiple free-tier accounts to circumvent credit limits.

4. Plans, Credits & Billing

Nexlon offers subscription plans (Free, Pro, and Business) and one-time credit packs, billed through Stripe.

  • Subscription fees are billed monthly in advance unless otherwise stated.
  • Credits are consumed per AI action (image generation, copy, SEO, etc.) and are non-refundable once used.
  • Unused credits do not expire while your subscription is active.
  • You may upgrade, downgrade, or cancel at any time; changes take effect at the next billing cycle.
  • All fees are exclusive of applicable taxes, which you are responsible for paying.

5. Refunds

Subscription payments are non-refundable except where required by law. If you believe you have been charged in error, contact us within 14 days of the charge. Credit pack purchases are final once the credits have been consumed.

6. Acceptable Use

You agree not to:

  • Use Nexlon to generate unlawful, defamatory, infringing, or harmful content.
  • Upload or process content you do not have the right to use.
  • Attempt to reverse engineer, scrape, or overload the platform or its AI providers.
  • Resell or sublicense access to Nexlon without authorization.
  • Use the public API or webhooks to transmit malware or conduct unauthorized data collection.

7. Intellectual Property

You retain ownership of the original content you upload and the assets generated from it. Nexlon retains ownership of the platform, software, brand, and underlying technology.

By using the AI tools, you grant Nexlon a limited license to process your content solely to provide the service to you. Generated outputs may be used for your commercial purposes subject to the rights of any underlying third-party inputs you provided.

8. AI Output Disclaimer

AI-generated content may contain inaccuracies or unintended results. You are responsible for reviewing all generated assets, copy, and metadata before publishing or using them commercially. Nexlon does not guarantee the accuracy, legality, or fitness of any AI output.

9. Third-Party Services

Nexlon integrates with third-party services including Stripe, AI model providers, and e-commerce platforms. We are not responsible for the availability or behavior of these services. Your use of connected platforms is subject to their respective terms.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features at any time without liability. Scheduled maintenance and outages may occur.

11. Termination

You may close your account at any time. We may suspend or terminate your access if you breach these Terms, engage in fraudulent activity, or for any reason with reasonable notice. Upon termination, your right to use the service ends, and your data may be deleted in accordance with our Privacy Policy.

12. Disclaimer of Warranties

Nexlon is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

13. Limitation of Liability

To the maximum extent permitted by law, Nexlon shall not be liable for any indirect, incidental, special, consequential, or lost-profit damages arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the preceding 12 months.

14. Indemnification

You agree to indemnify and hold Nexlon harmless from claims, damages, and expenses arising from your content, your use of the service, or your breach of these Terms.

15. Governing Law

These Terms are governed by the laws applicable in the jurisdiction where Nexlon is operated, without regard to conflict-of-law principles. Disputes will be resolved in the competent courts of that jurisdiction.

16. Changes to These Terms

We may update these Terms periodically. Material changes will be communicated via email or a notice within the platform. Continued use after changes take effect constitutes acceptance of the revised Terms.
